The ICJ does not judge the military past, but it does apply the criteria, delimitations, and precedents that were born\u2014or should have been born\u2014from those events. <\/p>\n\n<p class=\"\">Costa Rica came to this litigation with an incomplete historical baggage:<br\/>a <strong>narrative void<\/strong> inherited from the silencing of the Transit Campaign and the figure of Major M\u00e1ximo Blanco Rodr\u00edguez. This void, repeated in education, diplomacy, and politics, left out an essential component: the demonstration of <strong>effective control<\/strong>, historical use of the territory, and logistical dominance of the San Juan during 1856\u20131857.<br\/>That silence had consequences. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Why this document is key to the trilogy <em>Las Aguas del Olvido<\/em><\/strong><\/h3>\n\n<p class=\"\">In the trilogy\u2014<em>Las Aguas Amargas del San Juan<\/em>, <em>Aguas Silenciadas<\/em>, and <em>La Frontera del Agua<\/em>\u2014this case occupies a central place because it represents:<\/p>\n\n<h4 class=\"wp-block-heading\"><strong>1. The legal culmination of a century and a half of disputes.<\/strong><\/h4>\n\n<p class=\"\">The 2015 ruling is the final point of a chain that includes:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"\">the Ca\u00f1as\u2013Jerez Treaty (1858),<\/li>\n\n\n\n<li class=\"\">the Cleveland Award (1888),<\/li>\n\n\n\n<li class=\"\">the Alexander Agreement (1897),<\/li>\n\n\n\n<li class=\"\">the Jerez\u2013Molina Treaty (1896),<\/li>\n\n\n\n<li class=\"\">and a succession of interpretations, misunderstandings, diplomatic errors, and omissions.<\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\"><strong>2. The mirror where the fragility of the national narrative is observed.<\/strong><\/h4>\n\n<p class=\"\">Costa Rica defended a territory with legal solvency, but without the symbolic force of its complete history. The military memory of 1856\u20131857\u2014including the effective presence in Sarapiqu\u00ed, San Carlos, and the banks of the San Juan\u2014was never integrated into its modern diplomacy. <\/p>\n\n<p class=\"\">The ruling recognizes Costa Rican sovereignty but also exhibits how the country arrived at the court without a consolidated historical narrative that reinforced its arguments.<\/p>\n\n<h4 class=\"wp-block-heading\"><strong>3.
